TERMS & CONDITIONS  *  LIMITED WARRANTY INFORMATION   DELIVERY STANDARDS JOB COMPLETION If an item is in stock it will be shipped in under 14 days during the summer busy season- quicker at other times. If it needs to be produced, we ask 30 days to complete. We will put your job in line and get to it as fast as we can. Most orders do not take the full 30 days, and are shipped as quickly as possible. SHIPPING We ship anywhere. If you are within 100 miles you might consider picking your order up as you will save at least $100. We ship via common carrier and at the lowest rate available, which means you may have to assist the driver in unloading the freight from the back of the truck. If you need liftgate service or inside delivery or anything special, please make sure to tell us when ordering so that arrangements can be made. There will be added charges for added services. DAMAGES These products are extremely durable and very rarely suffer any real damage by the carriers. Light scratches can be fixed with a propane torch waived over the scratch for about 30 seconds. If you have Damages, we need to know about them right away and we need pictures for our claim to the freight carrier. Digital are preferred, but any will do as long as we can tell what the damage looks like. We can not settle any freight problems until we get pictures, please make them a priority. In most cases, we can send you a replacement via UPS or freight carrier in as soon as possible.    Please e-mail these pictures directly to info@curbappealmaterials.com and we will respond within 24 to 48 hours. RETURNS Hopefully, you are thrilled with your purchase and will get many years of use from it, but occasionally we find a customer who is unhappy and wants to return the product. That is not a problem for us. Simply ship the item back -at your expense- and we will issue a prompt refund, minus the outbound shipping costs and a fifteen percent restocking fee. (15%of the regular lumber and no returns for expanded lumber sizes) We stand behind our products and know that they are of a very high quality. We will make all efforts to fix whatever problem arises, and we want all our customers happy, so let us know if you have any issues.   CUSTOM COLORS: Our "Quick Ship" or Standard colors for picnic tables and benches are Cedar & Redwood.  If you decide to order a color other than these, although there isn't any extra charge, they are considered to be customer color orders, and cannot be cancelled or returned.  They can be exchanged, however, the shipping expenses will be at the expense of the customer, both from the customer and to the customer, and a 15% charge for restocking a custom color order will be charged. Custom Orders can't be cancelled or returned. Once the board is cut, you own it. This includes tongue and Groove, groove and groove, engraving, and any other special work to the board. See details below 50 Year Limited Warranty Curb Appeal Materials, Ltd. warrants to the original purchaser and no others that Curb Appeal Materials, Ltd., materials will not rot, split, crack, splinter or be adversely affected by insects including plastics for a period of 50 years (“Warranty Period”). This limited warranty shall apply to all such materials with respect to which a claim is made to Curb Appeal Materials, Ltd. (including return of the claimed defective material if required by Curb Appeal Materials, Ltd. as hereinafter provided) within the Warranty Period accompanied by an original receipt and a written statement describing each defect claimed and which Curb Appeal Materials, Ltd., inspection shows to be defective, provided that this limited warranty shall not apply to any materials which have been subject to accident, or improper handling, installation, maintenance, repair or alteration, or used in any way contrary to good standards of practice within the building industry. Curb Appeal Materials, Ltd. obligation under this limited warranty, and purchaser’s exclusive remedy for the breach thereof, shall be limited to Curb Appeal Materials, Ltd.  correction of any defect in material or workmanship by, at Curb Appeal Materials, Ltd. option and expense (excluding shipping, installation and any other charges): (i) repair of the defective materials; (ii) replacement of the defective materials; or (iii) refund of the original purchase price of the defective materials. Curb Appeal Materials, Ltd. reserves the right to require, as a condition to recognizing any claim under this limited warranty, purchaser’s return of any material, transportation charges prepaid buy purchaser, to Curb Appeal Materials, Ltd.  manufacturing plant for inspection and /or repair by Curb Appeal Materials, Ltd. Any goods repaired or replaced pursuant to this limited warranty shall be warranted for the unexpired portion of the Warranty Period applying to the original materials. THIS LIMIMTED WARRANTY IS EXPRESSLY MADE IN LIEU OF ANY AND ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. REFUND OF PURCHASE PRICE OR REPAIR OR REPLACEMENT OF DEFECTIVE GOODS AS PROVIDED ABOVE SHALL BE THE PURCHASER’S SOLE AND EXCLUSIVE REMEDY FOR CONTRACT, WARRANTY, NEGLIGENCE, TORT OR STRICT LIABILITY CLAIMS. IN NO EVENT SHALL EPS BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, ECONOMIC OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER (INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOST PROFITS, LOSS OF BUSINESS, BUSINESS INTERUPTION, OR ATTORNEY’S FEES) CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE, TORT, STRICT LIABILITY, BREACH OF CONTRACT, BREACH OF WARRANTY OR OTHER BREACH OF DUTY OF OR BY Curb Appeal Materials, Ltd. This warranty does not cover damage of any sort resulting from faulty installation, misuse, fire neglect or acts of God, and does not cover cosmetic items such as scratches, dents, stains, soiling or discoloration occurring in the normal course of usage. Petroleum products should not be used on Curb Appeal Materials, Ltd. materials and using any product with petroleum derivatives will void this warranty.
